Complex Valuation is a new seminar developed to give appraisers the skills to value both detrimental and beneficial conditions. The field of “complex valuation” involves the real estate characteristics that are “atypical.” (Federal Regulations Part 34.42.).

Many, if not most, valuation assignments involve a straightforward application of the cost, income and sales comparison approaches to value. However, frequently complex issues arise that involve either beneficial or detrimental conditions that can influence the value of real estate. For example, beneficial conditions might result in an increase in value, such as discovering minerals or oil on grazing land. Detrimental conditions could result in a diminution in value, such as natural disasters or environmental contamination.

As real estate appraisers, understanding these complexities helps in developing a credible opinion of value in these types of assignments. Although many complex issues are addressed throughout appraisal literature and coursework, they are not presented as a single framework. The purpose of the Complex Valuation course is to provide real estate appraisers with a comprehensive understanding of the topic and focus on these various property conditions and the valuation methodologies to address them. Instructors present with a comprehensive PowerPoint presentation.

DESCRIPTION: The Complex Valuation Exhibits serves as a course outline, where case studies will be presented to compare and contrast each of the 10 categories, as well as present practical methods to address the different complex valuation issues. This framework is an extension of the ten categories found within the Appraisal Institute’s Real Estate Damages text, which has been utilized for over 30 years.

Furthermore, to address the array of complex issues, real estate appraisers are trained to use a variety of approaches and methodologies. The approaches include the three traditional approaches to value and the real estate damage approaches:

Traditional Appraisal Approaches Real Estate Damage Approaches
Cost Approach Cost Effects
Income Approach Use Effects
Sales Comparison Approach Risk Effects

 

Within the different approaches to value, real estate appraisers can utilize a variety of techniques such as regression, paired sales, sale/resale, literature reviews, case studies, loss of use, project delay, and so forth. This course will present a general overview of the different techniques, including examples utilized in different complex valuation situations, and facilitate discussion.

Many class action lawsuits seek to address these complex valuation issues across numerous properties. The real estate appraisal profession plays an essential role in these lawsuits, as USPAP sets forth Standards 5 and 6, to address mass appraisal assignments. We will give a general overview of the different mass appraisal techniques an appraiser can consider and how these techniques can be utilized in mass-complex valuation assignments.

Business Practices and Ethics is an important course that provides information about standards and ethics requirements for valuers in general and, more specifically, for valuers who belong to the Appraisal Institute. Through discussion questions and examples, the class compares behavior and actions that illustrate violations of the Code of Professional Ethics, and participants learn how referrals can be made. Participants are also introduced to the Appraisal Institute Guide Notes to the Standards of Professional Practice and use these Guide Notes to resolve everyday appraisal practice problems. At the end of the course, they learn about common errors in appraisal reports and review reports, and they respond to questions about challenges that arise in appraisal practice such as requests for updates and requests to change or add intended users. These are common business practice issues that appraisers encounter in various assignments, including mortgage lending, litigation, and property tax appeal. Other real-life scenarios in the course illustrate less common business practice issues such as an appraiser’s obligation when illegal or criminal behavior is observed.  The content emphasizes:

  • Business practices issues, such as how to respond to seemingly unreasonable requests, how to address client pressure, and how to approach a complex assignment
  • Which standards apply to Appraisal Institute Designated Members, Candidates for Designation, Practicing Affiliates, and Affiliates, and when they apply
  • The key principles of the Standards of Valuation Practice
  • How to identify and avoid behavior that violates the Standards of Valuation Practice
  • The correct way to use the Appraisal Institute designations, emblems, and logo
  • Understanding of the Appraisal Institute enforcement process

About the Presenters

Richard Carabelli is President of Martin Appraisal Associates, which has been in business for over 60 years. He is the President of the Mercer County Board of Taxation, where he has served as a member for over 30 years. The municipal assessor in Franklin Township (Mercer County), Mr. Carabelli also serves on the Tax Court committee to the NJ Supreme Court.

John McCann is the President of the NJ State Appraisal Board. He is also is the owner of both John A. McCann and Associates Real Estate Appraisers, and C.A. McCann & Sons, Inc. Realtors. John has extensive experience and knowledge of the real estate industry through commercial/residential appraisals, real estate sales and rentals, along with a full-service property management company. As a past president of the Cape May County Association of Realtors and Realtor of the Year, John has a very clear understanding of the ins and outs of the MLS system. He is a member of the Cape May County Tax Board. After graduating LaSalle College in 1984, John went on to become the Captain of the Wildwood Beach Patrol.

Mala Sundar, P.J.T.C. was appointed to the Tax Court by Gov. Chris Christie and took her oath on July 27, 2009. She was reappointed in June 2016 by Christie. She became the presiding judge of the Tax Court on January 16, 2021. Prior to her judicial appointment, she had joined the NJ Division of Law as a deputy attorney general, representing state/governmental agencies on all taxation related issues. She completed her career there as section chief for transportation. She earned her law degree from Rutgers Law School in Camden.

NJ Appraiser Law, Regulations N.J.S.A. 45:14F-1, et seq. Real Estate Appraisers Act

Purpose: This course is required by NJ regulations every two years. Students will learn about the law itself, the regulations that pertain to the law including specific areas noted in the regulation.

  • Provide general information about the law and regulations
  • Provide some information about national licensing
  • Understand how NJ State Appraisal Board works
  • Explore misunderstood areas of Laws and Regulations
  • Discuss commonly found errors and issues (appraisals)
  • Provide references sources and information for licensees

All licensed and certified real estate appraisers shall be required to complete a two hour course on New Jersey law and rules governing the practice of real estate appraising.

  • the origin and history of the Real Estate Appraisers Act
  • the Board composition
  • scope of practice
  • mixed practice conflicts of interest
  • continuing education requirements and criteria duty to cooperate
  • temporary visiting certificates, trainee and supervisor requirements
  • appraisal reporting and common deficiencies and the complaint process
  • National Licensing stats, NJ testing and complaint stats, information including germane ASB and AQB issues.

VIRTUAL CLASSROOM VIA ZOOM

Virtual Classroom-Live/Interactive Participation Guidelines: Students must have computer, webcam & microphone capability to participate & receive continuing education credit. The platform will be interactive and live. The instructor must be able to physically see and interact with all students and students must be able see and interact with the instructor.

A copy of your driver’s license must be emailed to the Chapter office as verification after you have registered for the offering prior to the offering start date. You will receive a separate email from the Chapter Office with log-in/access information. You do not need a paid account from ZOOM to participate. If you are using your Ipad/Iphone/smartphone please download the ZOOM app prior to offering. Please check your webcam privacy settings on your computer. If you have a Lenovo laptop, you must have the Lenovo Vantage App installed on your computer for webcam to work.

Check state approvals before registering to make sure the states you are licensed have approved the course/seminar and allow Virtual education in place of classroom education during the pandemic.
