Business Practices and Ethics is an important course that provides information about standards and ethics requirements for valuers in general and, more specifically, for valuers who belong to the Appraisal Institute. Through discussion questions and examples, the class compares behavior and actions that illustrate violations of the Code of Professional Ethics, and participants learn how referrals can be made. Participants are also introduced to the Appraisal Institute Guide Notes to the Standards of Professional Practice and use these Guide Notes to resolve everyday appraisal practice problems. At the end of the course, they learn about common errors in appraisal reports and review reports, and they respond to questions about challenges that arise in appraisal practice such as requests for updates and requests to change or add intended users. These are common business practice issues that appraisers encounter in various assignments, including mortgage lending, litigation, and property tax appeal. Other real-life scenarios in the course illustrate less common business practice issues such as an appraiser’s obligation when illegal or criminal behavior is observed.

NEW SEMINAR!!!  Many markets are reporting a housing shortage particularly in the affordable housing sector.  As a result, municipalities are updating their zoning laws to allow one or more accessory dwelling units (ADUs) to be added to single-unit housing. If you are an appraiser involved in residential valuation where ADUs are part of this growing trend, this seminar is for you. It provides an overview on ADUs focusing on the description, legal concerns, valuation methods, and techniques needed to value them. You’ll learn about the valuation challenges and discover how the recent changes in the secondary mortgage market selling guidelines now provide more guidance and flexibility in valuing and financing ADUs. This seminar will help you complete appraisal assignments with ADUs competently. Objectives:

  • Understand the role ADUs play in the housing market.
  • Identify reasons ADUs are commonly added to an existing improvement.
  • Recognize characteristics of the most common buyers and renters of ADUs.
  • Apply the appropriate highest and best use analysis for ADUs as improved properties.
  • Identify the zoning criteria that may limit ADUs.
  • Understand secondary mortgage market appraisal guidelines and government appraisal guidelines and requirements.
  • List data challenges that complicate the assignment.
  • Solve short ADU dilemmas using valuation methods.

The update to the Uniform Appraisal Standards for Federal Land Acquisitions was released by the Interagency Land Acquisition Conference in December 2016. This is the first update to the standards since 2000. The 2-day Appraisal Institute course not only provides a comprehensive review of the Uniform Appraisal Standards for Federal Land Acquisitions, 6th edition, it also includes critical instruction to those involved in federal land acquisition valuation assignments. The course walks you through case studies that demonstrate practical procedures and solutions. Whether you are an experienced appraiser who writes or reviews federal land acquisition appraisals or you are an appraiser interested in expanding your client base to include federal and state agencies and organizations, this course will show you how to apply the 6th edition of the Uniform Appraisal Standards for Federal Land Acquisitions in practice. A 1-hour exam is included. ABOUT THE PRESENTERS

Eugene A. Soda, Jr. is Vice President of Valuation at WSFS Bank. He is a Certified Residential Appraiser in Delaware, New Jersey & Pennsylvania, with 36 years of appraisal experience.  Currently, Mr. Soda specializes in appraisal reviews, and is also working towards the AI-RRS designation with the Appraisal Institute. WSFS Financial Corporation is a financial services company. Its primary subsidiary, WSFS Bank, a federal savings bank, is the largest & longest-standing locally managed bank and trust company headquartered in Delaware and the Greater Delaware Valley.

Michael Lucey is a founding partner of Water’s Edge Environmental and Water’s Edge Mitigation.  Mr. Lucey is a certified Professional Wetlands Scientist with extensive experience in environmental consulting involving the management and supervision of environmental departments and project oversight as a team leader. A graduate of the University of Delaware, he has specialized experience in the design, construction and management of wetlands mitigation projects including the analysis of water budgets, vegetation selection and the administration of contracts to ensure successful establishment and survival of mitigated wetlands areas.  Mr. Lucey has over 20 years of experience in the performance of Phase I & II Environmental Site Assessments, general wildlife surveys, State and Federal environmental permitting associated with commercial & residential developments, waterfront development design and permitting, development feasibility analyses, delineation of freshwater and coastal wetlands boundaries, soils analyses and testing, habitat identification, environmental impact statements, and AutoCad design.

Marnie Niederhofer is Senior Biologist at Water’s Edge Environmental, LLC. Marnie is responsible for all phases of State and Federal environmental permit applications associated with waterfront and inland commercial and residential development. She has performed field freshwater and coastal wetlands delineations for New Jersey Department of Environmental Protection and U.S. Army Corps of Engineers and Pinelands Commission. She is responsible for the preparation of NJDEP Tidelands License and Grant Applications for residential development in coastal communities as well as responsible for the preparation of Phase I Environmental Assessments in accordance with ASTM Standards. Marnie performs general wildlife surveys, plant surveys and endangered and threatened species surveys. Marnie has extensive experience in the preparation of Compliance Assessment, Tidelands Evaluations and Pre-purchase assessment for residential and commercial properties.

Mala Sundar, P.J.T.C. was appointed to the Tax Court by Gov. Chris Christie and took her oath on July 27, 2009. She was reappointed in June 2016 by Christie. She became the presiding judge of the Tax Court on January 16, 2021. Prior to her judicial appointment, she had joined the NJ Division of Law as a deputy attorney general, representing state/governmental agencies on all taxation related issues. She completed her career there as section chief for transportation. She earned her law degree from Rutgers Law School in Camden.

We will start with a very informative seminar in their state of the art meeting room. What is “Green Energy”? What is “District Energy”? Are all types of green energy clean? What is the market potential for solar and wind projects? The second half of the seminar focuses on utility-scale wind and solar green energy, including a case study and specific current data on land values now and in the future. 

About the Instructor David Wilk, MAI, CRE, FRICS

David Wilk is Assistant Professor of Finance & Director of the Real Estate Program at Temple University Fox School of Business. He has over 30 years of real estate teaching experience between the University of Delaware Lerner College of Business, Johns Hopkins Carey Business School, and Georgetown University. 

Mr. Wilk is also a management consultant who creates value in today’s market for corporations, private equity firms, governments, universities, healthcare systems, and non-profits through asset optimization strategies that generate new earnings, valuations, market feasibility studies, “place-making” economic development strategies, and innovative marketing plans that reimagine underutlized real estate assets and urban neighborhoods. 

He has over 35 years of experience with commercial, industrial, residential, agricultural, governmental, and institutional real estate projects, and has worked in 49 states in the U.S., Canada, Mexico, Europe, South America, the Caribbean, Asia, and the South Pacific. He is a Certified General Appraiser in the States of Delaware, NY, Virginia, Florida, Maryland, and Washington, DC.

Appraisal reports convey opinions and conclusions that are to be based on credible market support.  However, the reality is that this does not always occur.  USPAP requires the appraisal to have market support, sound reasoning and logic for adjustments in a comparison analysis, all components in a cost analysis and the multiple aspects of an income analysis.  This program will address the need for meaningful market analysis for properties that commonly transact and are located in relatively stable markets, using industry approved and peer tested techniques within the Six Step process.

We will focus on how this can be accomplished in an inferred market study. Market analysis precedes and is the underpinning of the highest and best use analysis and conclusion.  Many valuation reports convey opinions but often lack the underlying data and analysis to support the opinions and conclusions expressed in the report.  The underlying market data and its analysis is often poorly communicated due to clients requesting a quick turn-around time frame or the impact of other restrictions.

This program delves into all aspects of an Inferred market analysis which is the underpinning of a meaningful highest and best use analysis and conclusion.  Each step in the Six Step process will connect theory and practice to assist residential and non-residential practitioners in writing more complete and meaningful appraisals, regardless of the medium used to communicate the report.  The goal will be to offer pragmatic ways to comply with USPAP and allow clients and intended users to more fully understand all the work done by an appraiser.  The program is designed to show how USPAP and appraisal practice and theory can be presented in a succinct manner that will be meaningful to users while demonstrating the depth of research and analysis that trained and experienced appraisers bring to assignments.  The intent is to protect the general public and meet the obligation expected in this industry.

The program reviews the underlying risk factors that impact all real estate & the role of equity when acquiring and owning real property. Appraisal assignments generally seek to value the whole property as of an effective date and practitioners use the methods and techniques taught academically & gained while on-the-job. We will review factors that contribute to many factors including but not limited to overall & yield rates. It views investments from both the lender & equity investors positions.

     While the various types of risk will be discussed, tools used by lenders will also be reviewed. Salient issues such as loan-to-value ratios, breakeven analysis, sensitivity need to be addressed when valuing income producing property. While most of the program will be relevant for the general practitioner, many risk issues are confronted by residentially valuers.

     This short program will also focus on the role equity plays when evaluating the real property rights. The program looks at the appraiser’s responsibilities as its pertains to the role of equity under USPAP, Interagency Guidelines, and similar documents such as Florida Statutes Title XXXII Regulation of Professions and Occupations which are used to evaluate the reasonableness of an appraisal service.

Appraisals or reviews of the most experienced appraisers can have inconsistencies in data, analysis, and reporting. This fast-paced and thought-provoking seminar focuses on significant inconsistencies that can have a major impact on the credibility of the appraiser as well as the value opinion. It will bring to light inconsistencies that can affect any part of the appraisal process including the definition of market value, highest and best use, the three approaches, functional and external obsolescence, and reconciliation. Eye-opening discussions and practical problems (including ag problems) will keep you interested and engaged throughout the day. Objectives:

  • Recognize inconsistencies with the definition of market value and the need to stay consistent with the type of value opinion developed.
  • Understand how the highest and best use decision drives the remainder of the appraisal process and how to stay consistent with highest and best use.
  • Realize the need for consistency within and between the three approaches to value.
  • Determine what constitutes functional and external obsolescence and how to maintain consistency with both in all three approaches.
  • Complete a thorough, meaningful, and consistent reconciliation.

MANDATORY CLASS FOR NJ APPRAISERS ONCE A RENEWAL CYCLE

NJ Appraiser Law, Regulations   N.J.S.A. 45:14F-1, et seq. Real Estate Appraisers Act

Purpose: This course is required by NJ regulations every two years.  Students will learn about the law itself, the regulations that pertain to the law including specific areas noted in the regulation.

13:40A-5.4 (b):  All licensed and certified real estate appraisers shall be required to complete a two hour course on New Jersey law and rules governing the practice of real estate appraising.
