Expert Testimony: Tips & Techniques for NJ Appraisers and Assessors: This seminar will provide guidance from an experienced property taxation attorney, an experienced MAI/CTA appraiser who is regularly engaged in Tax Court and County Board of Taxation hearings, and an experienced Tax Assessor who is also a County Tax Administrator. The seminar will focus on when to consider settling a case, when to proceed to Tax Court and when to negotiate a settlement. The other focus of the seminar will target common mistakes made by tax assessors and appraisers when providing expert testimony.

A View from the Bench: Judge Andresini will discuss tax court issues & recent cases from across the state. His insight and experience will be a great benefit to all.

Pamela J. Brodowski, MAI, ASA, CTA, is Principal of BRB Valuation & Consulting Services. She is a Certified General Appraiser in New Jersey and New York with approximately 30 years of professional experience with real estate appraisals. Ms. Brodowski has appeared as an expert witness before numerous New Jersey County Boards of Taxation, the State Tax Court of New Jersey, the Superior Court of New Jersey, and the Supreme Court of New York with major clients ranging from corporations, financial institutions/ law firms/ accounting firms, municipalities/courts, and state agencies/ courts/other jurisdictions.

Jeffrey M. Gradone is a Partner at Archer Law. He concentrates his practice in the areas of local property tax, redevelopment and condemnation. Jeff litigates complex property tax appeals in New Jersey, New York and Pennsylvania. He advises clients regarding property tax issues and liabilities, and pursues property tax exemptions, abatements, and other incentives for real estate development projects. Jeff also handles a variety of complex condemnation matters on behalf of property owners. Jeff has significant experience negotiating and obtaining tax exemptions and abatements for developers under New Jersey’s Long-Term Tax Exemption Law and Five-Year Exemption and Abatement Law. These programs provide for payments in lieu of taxes to help minimize property tax for new development and redevelopment projects, or to locate a project in a distressed or blighted area. Through these programs, Jeff assists clients in securing property tax exemptions, which would be in effect for a set period of time. Those clients have been able to make an annual payment that was much less than what their traditional tax would have been. Jeff’s clients have been able to save in real estate taxes, as well as increase the fair market value of their property. Following law school, Jeff clerked for Judge Harold A. Kuskin of the New Jersey Tax Court, where he worked on seminal cases involving taxation of heavy industrial facilities and issues related to long-term tax abatements.

Diane Hesley, CTA, is currently the Camden County Tax Administrator. She is the Immediate Past President of the Association of Municipal Assessors of New Jersey and is a member of the NJ Chapter of the International Association of Assessing Officers. She is the Part-time Assessor for the City of Linwood in Atlantic County. Diane is also an instructor for Rutgers University teaching property tax administration. She has been in the assessment, reassessment & valuation profession for over 30 years.

Joseph M. Andresini, P.J.T.C. took the oath of office as presiding judge on January 16, 2018. Judge Andresini began his time with the tax court in October 2009. Prior to that, he served as a Municipal Court Judge in the Borough of Haworth. He earned his Jurist Doctorate from Seton Hall School of Law in 1984.

The Cost Approach: Unnecessary or Vital to a Healthy Practice? @ via ZOOM

How often have you have heard residential appraisers don’t need the cost approach to obtain credible assignment results? Participants in the secondary market often suggest this, and it’s even highlighted in the Fannie Mae Selling Guide that the cost approach is only required for the valuing manufactured homes. Unfortunately, not understanding the cost approach limits your ability to properly support adjustments in the sales comparison approach, understand trends in market conditions that are often driven by building costs, and recognize and quantify the forms of depreciation that can affect residential improvements. By better understanding the 8 important steps in the cost approach, you can rely on its indications whether you have little data, confusing data, or lots of data. Presentations and case studies will help you better understand the key connection between proficiency with the cost approach and your ability to support your adjustments in the sales comparison approach. This much needed seminar will show you that the cost approach truly is relevant!

NJ Appraiser Law, Regulations N.J.S.A. 45:14F-1, et seq. Real Estate Appraisers Act Purpose:

This course is required by NJ regulations every two years. Students will learn about the law itself, the regulations that pertain to the law including specific areas noted in the regulation.

All licensed and certified real estate appraisers shall be required to complete a two hour course on New Jersey law and rules governing the practice of real estate appraising.

Business Practices and Ethics is an important course that provides information about standards and ethics requirements for valuers in general and, more specifically, for valuers who belong to the Appraisal Institute. Through discussion questions and examples, the class compares behavior and actions that illustrate violations of the Code of Professional Ethics, and participants learn how referrals can be made. Participants are also introduced to the Appraisal Institute Guide Notes to the Standards of Professional Practice and use these Guide Notes to resolve everyday appraisal practice problems. At the end of the course, they learn about common errors in appraisal reports and review reports, and they respond to questions about challenges that arise in appraisal practice such as requests for updates and requests to change or add intended users. These are common business practice issues that appraisers encounter in various assignments, including mortgage lending, litigation, and property tax appeal. Other real-life scenarios in the course illustrate less common business practice issues such as an appraiser’s obligation when illegal or criminal behavior is observed.

Covid-19 Impact on Southern NJ Appraisers and Assessors

Residential values for the most part are on fire, land prices increasing. NOW WHAT? Are people laughing all the way to the bank, or losing everything? This seminar will provide guidance from an experienced MAI/CTA appraiser who is regularly engaged in Tax Court and County Board of Taxation hearings, and an experienced Tax Assessor who is also a County Tax Administrator. We will also hear from an expert in the office market: what is happening there as people work from home? The seminar will focus how a global pandemic affected real estate prices both commercially and residentially. We will learn about the impact on appeals as well as revaluations.

About the Presenters

Pamela J. Brodowski, MAI, ASA, CTA, is Principal of BRB Valuation & Consulting Services She is a Certified General Appraiser in New Jersey and New York with approximately 30 years of professional experience with real estate appraisals. Ms. Brodowski has appeared as an expert witness before numerous New Jersey County Boards of Taxation, the State Tax Court of New Jersey, the Superior Court of New Jersey, and the Supreme Court of New York with major clients ranging from corporations, financial institutions/ law firms/ accounting firms, municipalities/courts, and state agencies/ courts/other jurisdictions.

Anne Klein is an Executive Managing Director at Newmark Knight Frank. She is a 33-year veteran, and consistent top producer, of the commercial real estate industry. Based in South Jersey, she provides tenants and owners with a wide range of services including workplace strategy, labor pool analysis, state incentive shopping and acquisitions/dispositions. In addition to representing tenants in the U.S. and throughout the world, Ms. Klein has extensive experience representing local and institutional owners to market their properties, increasing the value through successful leasing and sales.

Thomas Mancuso, CTA  was appointed to the position of Tax Assessor for the Township of Plainsboro in August of 2008. He has over 29 years of service as a Tax Assessor with 12 of those years serving in East Brunswick Township. He left government in 2003 to pursue a position with BRB Valuation & Consulting Services, LLC, an appraisal firm that specialized in valuation for tax appeals and other appraisal issues. During that time he worked both for and against municipalities which has given him a better understanding of Ad Valorem issue from both perspectives. He is a Certified Tax Assessor and a State Certified General Real Estate Appraiser.

 

Mala Sundar, P.J.T.C. was appointed to the Tax Court by Gov. Chris Christie and took her oath on July 27, 2009. She was reappointed in June 2016 by Christie. She became the presiding judge of the Tax Court on January 16, 2021. Prior to her judicial appointment, she had joined the NJ Division of Law as a deputy attorney general, representing state/governmental agencies on all taxation related issues. She completed her career there as section chief for transportation. She earned her law degree from Rutgers Law School in Camden.
