Business Practices and Ethics is an important course that provides information about standards and ethics requirements for valuers in general and, more specifically, for valuers who belong to the Appraisal Institute. Through discussion questions and examples, the class compares behavior and actions that illustrate violations of the Code of Professional Ethics, and participants learn how referrals can be made. Participants are also introduced to the Appraisal Institute Guide Notes to the Standards of Professional Practice and use these Guide Notes to resolve everyday appraisal practice problems. At the end of the course, they learn about common errors in appraisal reports and review reports, and they respond to questions about challenges that arise in appraisal practice such as requests for updates and requests to change or add intended users. These are common business practice issues that appraisers encounter in various assignments, including mortgage lending, litigation, and property tax appeal. Other real-life scenarios in the course illustrate less common business practice issues such as an appraiser’s obligation when illegal or criminal behavior is observed. The content emphasizes:
- Business practices issues, such as how to respond to seemingly unreasonable requests, how to address client pressure, and how to approach a complex assignment
- Which standards apply to Appraisal Institute Designated Members, Candidates for Designation, Practicing Affiliates, and Affiliates, and when they apply
- The key principles of the Standards of Valuation Practice
- How to identify and avoid behavior that violates the Standards of Valuation Practice
- The correct way to use the Appraisal Institute designations, emblems, and logo
- Understanding of the Appraisal Institute enforcement process

About the Presenters
Richard Carabelli is President of Martin Appraisal Associates, which has been in business for over 60 years. He is the President of the Mercer County Board of Taxation, where he has served as a member for over 30 years. The municipal assessor in Franklin Township (Mercer County), Mr. Carabelli also serves on the Tax Court committee to the NJ Supreme Court.
John McCann is the President of the NJ State Appraisal Board. He is also is the owner of both John A. McCann and Associates Real Estate Appraisers, and C.A. McCann & Sons, Inc. Realtors. John has extensive experience and knowledge of the real estate industry through commercial/residential appraisals, real estate sales and rentals, along with a full-service property management company. As a past president of the Cape May County Association of Realtors and Realtor of the Year, John has a very clear understanding of the ins and outs of the MLS system. He is a member of the Cape May County Tax Board. After graduating LaSalle College in 1984, John went on to become the Captain of the Wildwood Beach Patrol.
Mala Sundar, P.J.T.C. was appointed to the Tax Court by Gov. Chris Christie and took her oath on July 27, 2009. She was reappointed in June 2016 by Christie. She became the presiding judge of the Tax Court on January 16, 2021. Prior to her judicial appointment, she had joined the NJ Division of Law as a deputy attorney general, representing state/governmental agencies on all taxation related issues. She completed her career there as section chief for transportation. She earned her law degree from Rutgers Law School in Camden.

The seminar provides a framework and considerations for attacking and defending an appraisal in litigation. Common mistakes made in appraising and testifying concerning an appraisal are stressed. Various standards and ethical rules that are frequently misapplied or misunderstood are highlighted and explained. In addition, common tricks and how to prepare for tricks on cross-examination are identified, as well as answering hypothetical questions at trial. A case study will be used to apply the Attacking & Defending Model.
About the Presenter: Ted Whitmer, MAI AI-GRS CRE CCIM AQB is a Certified USPAP Instructor, served on the TALCB, and was vice chairman of the Board. Ted is a Certified General Appraiser, licensed as a lawyer with the State of Texas and as a Real Estate Broker. He passed the Texas bar in 1988. Previous experience includes teaching every required course in the Appraisal Institute towards the MAI designation, authoring and teaching the Comprehensive Appraisal Workshop as a review for the comprehensive examination for the MAI designation and previously teaching Standards & Ethics, including USPAP. In addition, Ted has authored and instructed many seminars for continuing education including Attacking & Defending an Appraisal in Litigation, which is given to appraisers, lawyers and government employees associated with Boards and other state and federal agencies. In addition to teaching, Ted has extensive experience in consulting including advising in cases with appraiser board enforcement, criminal fraud and civil liability issues. Past experience in consulting, teaching, serving on the TALCB, and having extensive knowledge of appraisal issues, theory and USPAP make Ted uniquely qualified to represent appraisers.

The goal of the valuation process is to deliver well-researched and supportable conclusions. The Critical Thinking & Junk Science course includes both principles and case studies for the appraisal professional. The three approaches to value (cost, income and sales comparison), coupled with complex issues set forth in USPAP AO-9 (cost, use and risk effects) established a solid valuation framework.
Critical Thinking and Junk Science expands an appraiser’s professional skill set by focusing upon five topics within the context of real estate valuation:
- Epistemologies. The academic community has long identified research methods to collect and build credible knowledge and are discussed within the context of valuation.
- Critical Thinking. Appraisers must employ an objective analysis that allows them to form credible opinions, especially when involving complex or “atypical” properties.2
- Logical Fallacies. Appraisers should avoid invalid or faulty reasoning and comply with USPAP, and established methodologies primarily set forth by the Appraisal Institute.
- Cognitive Bias. Appraisers should avoid any systematic pattern of deviation from rationality or established standards and ethics of the appraisal profession.
- Junk Science. Appraisers must avoid unproven or untested tactics or theories when presenting an opinion of value. These tactics are explored, along with how to rebut them.
Appraisers are licensed professionals, and their opinions should be unbiased and reflect credible value conclusions.3 Valuation judgments must promote transparency, minimize subjective factors, be applied objectively to avoid biased analyses, opinions and conclusions.4
Understanding these complexities helps develop a credible opinion of value. While many of these issues are addressed throughout USPAP, professional literature and coursework, this course focuses on them in a single framework.
About Presenters:
Dr. Randall Bell specializes in real estate damage economics and valuation. This includes environmental, geotechnical, construction defects, natural disasters, eminent domain, and other conditions involving a wide variety of property types. He is experienced in complex valuation and diminution in value studies and damage issues for government, major corporations, oil and utility companies, and property owners. He is licensed in various states and has testified as an expert in multiple courts. Dr. Bell was the retained expert in the World Trade Center, Flight 93, Bikini Atoll Nuclear Test Site, OJ Simpson, Jon Benet Ramsey, Hurricane Katrina, Hurricane Harvey, Flint Michigan and multiple wildfires.
Dr. Michael Tachovsky specializes in real estate damage valuation and economics; this includes environmental contamination, natural disasters, eminent domain, crime scenes, construction defects, and other conditions involving a wide variety of property types. His professional experience includes complex valuation and diminution-in-value studies; including damage issues for the government, major corporations, oil and utility companies, developers, and property owners. His experience includes speaking engagements and published writing assignments on these topics.

NJ Appraiser Law, Regulations N.J.S.A. 45:14F-1, et seq. Real Estate Appraisers Act
Purpose: This course is required by NJ regulations every two years. Students will learn about the law itself, the regulations that pertain to the law including specific areas noted in the regulation.
13:40A-5.4 (b): All licensed and certified real estate appraisers shall be required to complete a two hour course on New Jersey law and rules governing the practice of real estate appraising.
