NJ Appraiser Law, Regulations N.J.S.A. 45:14F-1, et seq. Real Estate Appraisers Act

Purpose: This course is required by NJ regulations every two years. Students will learn about the law itself, the regulations that pertain to the law including specific areas noted in the regulation.

  • Provide general information about the law and regulations
  • Provide some information about national licensing
  • Understand how NJ State Appraisal Board works
  • Explore misunderstood areas of Laws and Regulations
  • Discuss commonly found errors and issues (appraisals)
  • Provide references sources and information for licensees

All licensed and certified real estate appraisers shall be required to complete a two hour course on New Jersey law and rules governing the practice of real estate appraising.

  • the origin and history of the Real Estate Appraisers Act
  • the Board composition
  • scope of practice
  • mixed practice conflicts of interest
  • continuing education requirements and criteria duty to cooperate
  • temporary visiting certificates, trainee and supervisor requirements
  • appraisal reporting and common deficiencies and the complaint process
  • National Licensing stats, NJ testing and complaint stats, information including germane ASB and AQB issues.

Attacking & Defending an Appraisal in Litigation (Seminar At the Shore – Day 1) @ Golden Nugget, Biscayne Room.

The seminar provides a framework and considerations for attacking and defending an appraisal in litigation. Common mistakes made in appraising and testifying concerning an appraisal are stressed. Various standards and ethical rules that are frequently misapplied or misunderstood are highlighted and explained. In addition, common tricks and how to prepare for tricks on cross-examination are identified, as well as answering hypothetical questions at trial. A case study will be used to apply the Attacking & Defending Model.

About the Presenter: Ted Whitmer, MAI AI-GRS CRE CCIM AQB is a Certified USPAP Instructor, served on the TALCB, and was vice chairman of the Board. Ted is a Certified General Appraiser, licensed as a lawyer with the State of Texas and as a Real Estate Broker. He passed the Texas bar in 1988. Previous experience includes teaching every required course in the Appraisal Institute towards the MAI designation, authoring and teaching the Comprehensive Appraisal Workshop as a review for the comprehensive examination for the MAI designation and previously teaching Standards & Ethics, including USPAP. In addition, Ted has authored and instructed many seminars for continuing education including Attacking & Defending an Appraisal in Litigation, which is given to appraisers, lawyers and government employees associated with Boards and other state and federal agencies. In addition to teaching, Ted has extensive experience in consulting including advising in cases with appraiser board enforcement, criminal fraud and civil liability issues. Past experience in consulting, teaching, serving on the TALCB, and having extensive knowledge of appraisal issues, theory and USPAP make Ted uniquely qualified to represent appraisers.

The goal of the valuation process is to deliver well-researched and supportable conclusions. The Critical Thinking & Junk Science course includes both principles and case studies for the appraisal professional. The three approaches to value (cost, income and sales comparison), coupled with complex issues set forth in USPAP AO-9 (cost, use and risk effects) established a solid valuation framework.

Critical Thinking and Junk Science expands an appraiser’s professional skill set by focusing upon five topics within the context of real estate valuation:

  1. Epistemologies. The academic community has long identified research methods to collect and build credible knowledge and are discussed within the context of valuation.
  2. Critical Thinking. Appraisers must employ an objective analysis that allows them to form credible opinions, especially when involving complex or “atypical” properties.2
  3. Logical Fallacies. Appraisers should avoid invalid or faulty reasoning and comply with USPAP, and established methodologies primarily set forth by the Appraisal Institute.
  4. Cognitive Bias. Appraisers should avoid any systematic pattern of deviation from rationality or established standards and ethics of the appraisal profession.
  5. Junk Science. Appraisers must avoid unproven or untested tactics or theories when presenting an opinion of value. These tactics are explored, along with how to rebut them.

Appraisers are licensed professionals, and their opinions should be unbiased and reflect credible value conclusions.3 Valuation judgments must promote transparency, minimize subjective factors, be applied objectively to avoid biased analyses, opinions and conclusions.4

Understanding these complexities helps develop a credible opinion of value. While many of these issues are addressed throughout USPAP, professional literature and coursework, this course focuses on them in a single framework.

About Presenters:

Dr. Randall Bell specializes in real estate damage economics and valuation. This includes environmental, geotechnical, construction defects, natural disasters, eminent domain, and other conditions involving a wide variety of property types. He is experienced in complex valuation and diminution in value studies and damage issues for government, major corporations, oil and utility companies, and property owners. He is licensed in various states and has testified as an expert in multiple courts.    Dr. Bell was the retained expert in the World Trade Center, Flight 93, Bikini Atoll Nuclear Test Site, OJ Simpson, Jon Benet Ramsey, Hurricane Katrina, Hurricane Harvey, Flint Michigan and multiple wildfires.

Dr. Michael Tachovsky specializes in real estate damage valuation and economics; this includes environmental contamination, natural disasters, eminent domain, crime scenes, construction defects, and other conditions involving a wide variety of property types. His professional experience includes complex valuation and diminution-in-value studies; including damage issues for the government, major corporations, oil and utility companies, developers, and property owners. Spotlight on Common Errors:  We will address problem areas that often are observed in appraisal reports submitted to the Appraisal Institute for admission and ethics screening. You will review most commonly noted reporting errors, review commonly noted methodology errors, review the characteristics of convincing appraisal reports.

Spotlight on Record Keeping:  We will discuss workfiles. A workfile is required by USPAP for all appraisals, appraisal consulting, and appraisal review assignments. In this program you will learn why USPAP requires a workfile for all appraisals and what it must contain. You will also learn when a workfile needs to be created, where it should be kept, and for how long.

Spotlight on Review:  We will focus on USPAP requirements relating to review, with practical guidance on the challenges reviewers face in providing review services. We will address the numerous misconceptions about review and how USPAP’s scope of work concept applies. You will discuss practices that improve efficiency and make sense in the real world, including identifying the subject of review. Participants will also discuss a handy checklist of 13 items that will be important to any reviewer completing an appraisal report; you will also learn the correct terminology to use in a review report.

Advanced Land Valuation: Sound Solutions to Perplexing Problems (7 CE Hours) @ via Zoom

This required 7-hour continuing education course, copyrighted by The Appraisal Foundation, focuses on USPAP requirements for ethical behavior and competent performance by appraisers. New case studies and tools are provided to help you learn how to better navigate USPAP in order to solve problems in your daily appraisal practice, and a USPAP Reference Manual is included with the course handbook. The topic of bias and appraisal practice will be covered using Advisory Opinion 16 showing how an appraiser can comply with USPAP as it relates to fair housing laws. The course will help you gain competency in USPAP, and it will help those subject to state licensing or certification and continuing education requirements imposed by professional organizations, client groups, or employers gain competency as well.

NOTE: Appraisers must successfully complete the 7-Hour National USPAP Continuing Education Course every 2 years to meet the USPAP continuing education requirement.

Registration includes course materials (not the USPAP Manual from the Appraisal Foundation).
When you registered for the course the default is to download the course material. If you want hardcopy you have to select that option and there will be an extra fee. This material is required for the course, but it is not the USPAP Manual, it is the student handbook for the class. You are required to have this material in class, hardcopy or downloaded on a computer. This is not peculiar to this class. This is true for all courses offered by the Appraisal Institute. The default to is to download the material and as you check out you have the option of paying extra to get a printed copy sent to you.

When you registered you will receive a confirmation email from the Appraisal Institute. That email has the link to the downloadable material. If you did not receive the confirmation e-mail from AI, first check your spam folder and if it is not there, confirm your email address in your AI account. If you still cannot find it please contact me. But you can still access your downloads through your account. Login and go to “My Account” and click on “Education and Events.” There you will see the class listed, just click on that and your download will be there.

Again, the course material does not include the current USPAP Manual.

Do you find yourself hesitating before taking on an assignment requiring a Level C marketability analysis? Do you think the process is complex and time consuming? When market conditions are changing, an understanding of fundamental demand concepts and the ability to apply them is necessary to do the valuation competently. This seminar simplifies and demystifies the process of fundamental demand analysis. After reviewing market cycles and the basic economic concepts underlying fundamental analysis, you will learn how to implement the six-step process by applying the concepts to three practical case studies dealing with a general office market, land development (subdivision), and a rental apartment building. You will use basic templates that can be used later in your daily work. By the end of the seminar, you should be better prepared to start including fundamental analysis in your work.
